Terms of Service

1. Overview

Cloud-9 ("the Service") is operated by Medhane Mekonnen and Johannes Breitfeld ("we," "us," or "Cloud-9"). By accessing or using cloud-9opt.com, you agree to these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. What Cloud-9 Does

Cloud-9 analyses publicly available AWS spot price data to generate cost optimisation recommendations, infrastructure configuration files (Terraform, Karpenter YAML), and — for users who opt in — applies configuration changes to AWS Auto Scaling Groups via a cross-account IAM role that you create and control.

All recommendations are based on historical and real-time public market data. Cloud-9 does not guarantee spot instance availability, pricing, or interruption rates — these are determined solely by AWS.

3. Autopilot — Scope and Your Control

The Autopilot feature allows Cloud-9 to update the mixed instances policy of AWS Auto Scaling Groups you explicitly select. The following boundaries apply and cannot be changed without your action:

  • You create and own the IAM role. Cloud-9 cannot modify its permissions or scope.
  • Cloud-9 only updates Auto Scaling Group instance configuration — it does not launch, terminate, stop, or restart any instance.
  • Every change Cloud-9 makes is immediately visible in your AWS Console and reversible in one click.
  • You can revoke Cloud-9's access at any time by disconnecting or deleting the IAM role.
  • Cloud-9 only acts on the specific ASG you select, only when you initiate a deployment.

4. Your Responsibilities

You are responsible for:

  • Reviewing all generated configuration files before applying them to your infrastructure.
  • Ensuring that any IAM role you create grants only the permissions you intend to grant.
  • Testing configuration changes in non-production environments before applying them to production workloads.
  • Maintaining appropriate backups and rollback procedures for your infrastructure.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Cloud-9 and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, business interruption, or infrastructure costs arising from your use of the Service or any configuration changes applied through it.

Cloud-9's total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Cloud-9 in the three months preceding the claim.

Cloud-9 provides infrastructure recommendations and configuration tooling. Decisions about whether to apply any recommendation to your infrastructure remain entirely yours.

6. No Warranty

The Service is provided "as is" and "as available." Cloud-9 makes no warranties, express or implied, regarding the accuracy of spot price predictions, the suitability of generated configurations for your workload, or the availability of the Service itself. Spot instance pricing and availability are controlled by AWS and are subject to change without notice.

7. Data

Cloud-9 stores your email address, authentication credentials (via Supabase), subscription status, and — if you use Autopilot — the ARN of the IAM role you provide. Cloud-9 does not store your AWS credentials, access keys, or any data from inside your AWS account.

Spot price data analysed by Cloud-9 is sourced from the AWS public spot pricing API and does not contain any customer-specific information.

8. Payments and Cancellation

Pro plan subscriptions are billed monthly via Stripe. You may cancel at any time; your access continues until the end of the current billing period. Refunds are not issued for partial months.

9. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated by email.
